Rules and Regulations

Winner will be randomly drawn and announced by MONTH DAY, 2025. Answer to skill testing question required.

HOW TO ENTER:
1. Find the unique entry code found on the inside of our Steam Whistle Pilsner (24 x 355ml) to be entered online prior to the contest close date.

The Steam Whistle Beau Lake iSUP Contest (the “Contest”) is conducted by Steam Whistle Brewing (the “Sponsor”).  The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor privacy policy (see below).

ELIGIBILITY:
Contest is open to Ontario and Quebec residents who are 19 years of age or older and who are not employed with, or are a member of the immediate family of, or domiciled with the Sponsor, their affiliated companies, their respective advertising or promotional agencies, the Liquor Control Board of Ontario (“LCBO”), an employee of the Alcohol and Gaming Commission of Ontario (“AGCO”) or of any licensees authorized by AGCO;

CONTEST PERIOD:
Entry into the Contest commences at 12:01 a.m. ET on MONTH DAY, 2025 and closes at 12:00 p.m. ET on MONTH DAY, 2025 (the “Entry Period”).  All entries must be received on or before the Contest closing date.

HOW TO PLAY:
Visit https://steamwhistle.ca/pages/beaulakecontest and enter your name, address, e-mail, telephone number and your unique entry code. Each person can submit one (1) entry with each unique entry code, with no limit to the number of entries. Entries generated by script, macro or other automated means and entries by any means which subvert the entry process are void. Entries must be received prior to the close of the Entry Period. Entries received after the Entry Period are void. Sponsor reserves the right to disqualify an entry for any reason whatsoever at its sole discretion. All decisions of the Sponsor shall be final and are not subject to appeal. Participants may not share the same email address. Participants may not enter with multiple email addresses, nor may participants use any other device to enter under multiple identities.  Any participant who attempts to enter with multiple email addresses or accounts under multiple identities will be disqualified and shall forfeit any prize won, in the Sponsor’s sole discretion.

There is no responsibility assumed by the Sponsor for the inability of a potential entrant to successfully enter the contest for any reason, and the Sponsor shall not be responsible for late, lost, damaged, illegible or incomplete entries.

PRIZES:
Entrants will have a chance to win one prize over the course of the Entry Period, with the one prize being drawn after the Entry Period has concluded. Entries completed in accordance with these Rules will be entered for a chance to win the one Prize available to be won. 

The Prize is as follows, each subject to the terms and conditions set out in Section 7 below:

PRIZE RESTRICTIONS:
Each entrant is only eligible to win one (1) Prize. Fees, taxes and surcharges are not included and must be paid for by the Prize winner with a valid credit card in their name at the time of booking the Prize.

The Prize must be taken as offered and is neither transferable nor redeemable for cash, credit or alternative prizes, except in the Sponsor’s sole discretion. Prizes cannot be sold and in the event that it is sold, the Prize will be void. The Sponsor reserves the right to substitute any prize with a prize of equal or greater value. No credit or reimbursement will be provided if a prize is not taken. Prize cannot be combined with any other promotional offer or offers provided by the Sponsor.

WINNER SELECTION AND NOTIFICATION  

ODDS:
Odds of winning a Prize depend on the number of eligible entries received during the Entry Period.

WINNER NOTIFICATION:
The potential winner will be contacted after 12:00 noon (ET) on ______ via email or phone. To be awarded a Prize, the potential winner must correctly answer unassisted a time-limited arithmetic skill-testing question without electronic, mechanical or any other kind of assistance by telephone at a pre-determined mutually convenient time. The contest is subject to all applicable federal, provincial, and municipal laws. By entering the contest, entrants agree to abide by the contest rules and decisions of the Sponsor which are final. No correspondence will be undertaken except with the selected Eligible Participants whose Eligible Entry was drawn.

PRIVACY & PERSONAL INFORMATION:
By entering the contest or accepting a prize, entrants consent to the collection, use, storage and distribution of their personal information, including without limitation their name, address, telephone number, age and/or digital or photographic image and likeness by the Sponsor, in reference to all matters related to the contest or in any publicity carried out by them without compensation and agree to abide by the Contest Rules and the decisions of the Sponsor, which are final. Such information is stored for only so long as required to complete the purpose for which it was collected. The entrant's personal information shall not be provided to any third party by the Sponsor without the entrant's consent. If an entrant would like their personal information removed from the Sponsor's database at the conclusion of the contest, send this request in writing to info@steamwhistle.ca. Please see Steam Whistle Brewing's Privacy Policy at https://steamwhistle.ca/pages/privacy-policy for information on its policy towards maintaining the privacy and security of personal information. No further informational or marketing communications will be received by the entrants unless entrants provide the Sponsor with explicit permission to do so by checking the information check-box on the official entry materials. By specifically checking any additional third party information check-box on the official entry materials, entrants consent to that third party using the personal information submitted with such entry including, but not limited to, contacting the entrant in the future to provide electronic newsletters and mailings, and other promotions and product and/or service offerings by the third party organization.  Please see the third party’s privacy policy and/or contact the third party directly to unsubscribe from any future electronic newsletters, mailings and other promotions. Receiving informational and marketing communications does not improve the odds to win a prize in the contest. By specifically checking a communication preference check-box on the official entry materials, the entrant agrees to be contacted via electronic address (e.g. direct message, e-mail, SMS) for the purposes of the administration or promotion of the relevant contest.  

RELEASE AND INDEMNIFICATION:
By entering the contest, each entrant releases and holds harmless the Sponsor, Beau Lake, their respective agents, representatives and associated companies, and all of their respective directors, officers and employees from any and all liability for injuries, loss or damage of any kind whatsoever including without limitation personal injury, death or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of any prize, participation in the contest, or participation in any prize related activity and agrees to fully indemnify the Sponsor, Beau Lake, and their respective agents, representatives and associated companies, all of their respective directors, officers and employees from claims by third parties without limitation.

GENERAL:
All entries become the property of the Sponsor who assumes no responsibility for entries that are lost, late, delayed, destroyed or misdirected for any reason whatsoever or for any computer errors or malfunctions. Neither the Sponsor, Beau Lake nor their respective agents shall be responsible for any errors, negligence, losses or damages of any nature whatsoever that may arise or occur in connection with the contest or a prize. The Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical error, seeding or printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials and data that have been tampered with or altered are void. If for any reason, in the opinion of the Sponsor, in its sole discretion, the contest is not capable of running as originally planned, or if the administration, security, fairness, integrity or the proper conduct of the contest is corrupted or adversely affected, including by reason of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond its control, the Sponsor reserves its  right to cancel, terminate, modify, amend, extend or suspend the contest including canceling any method of entry, and select a winner from previously received eligible entries. The Sponsor reserves the right to modify the Contest Rules without materially affecting the terms and conditions hereof. The Sponsor in its sole discretion, further reserves the right to terminate any on-line portion of the contest and conduct the drawing from all on-line entries previously received during the contest period. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of the Contest Rules or otherwise in a disruptive manner. Any attempts to deliberately damage any web site or to undermine the legitimate operation of the contest is a violation of criminal and civil laws and should such an attempt be made the Sponsor reserves the right to seek remedies and damages to the fullest extent of the law. The Sponsor and Beau Lake shall not be held responsible for any errors or negligence that may arise or occur in connection with the contest including any damage to an entrant's computer equipment, system, software or any combination thereof, as a result of their participation in the contest or from downloading any material from the contest web site, where applicable. The Sponsor and Beau Lake may modify or withdraw the contest, without liability if any printing or production errors occur, without public notice.  

INTELLECTUAL PROPERTY:
All intellectual property, including, without limitation, all trademarks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned or licensed by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

PERSONAL INFORMATION:
Personal information collected from entrants will only be used by the Sponsor to conduct the Contest and fulfill any Prize requirements and, only if consent is given at the time of entry, to provide the entrants with information regarding upcoming promotions and/or events from the Sponsor.

GOVERNING LAW:
Subject to applicable law and these Official Rules, this Contest and the Official Rules shall be governed by Ontario law and all entrants expressly agree that the Ontario courts shall have sole jurisdiction over any dispute or litigation arising from or relating to this Contest and agree to submit to the jurisdiction of the courts of Ontario. The venue of any dispute or litigation shall be Toronto, Ontario. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these official rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. 

SUBJECT TO APPLICABLE LAWS:
The Contest is subject to these complete official rules and all applicable federal, provincial and local laws and regulations. By participating in the Contest, you acknowledge that you have read the official rules and agree to abide by their terms and by the decisions of the Sponsor, which are final and binding on all matters pertaining to the Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor. All federal, provincial and local laws and regulations apply. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.

LANGUAGE DISCREPANCY:
In the event of any discrepancy or inconsistency between the terms and conditions of these official rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to, point of sale, television, print or online advertising, the terms and conditions of these official rules shall prevail, govern and control.

QUEBEC RESIDENTS:
Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
